U.S. Supreme Court Victory in Montgomery v. Caribe Transport II, LLC
Creed & Gowdy is pleased to announce a significant ruling in Montgomery v. Caribe Transport II, LLC. On May 14, 2026, the Supreme Court of the United States unanimously held that a negligent-hiring claim against a freight broker is not preempted by the Federal Aviation Administration Authorization Act. The decision reverses the Seventh Circuit’s ruling and allows Mr. Montgomery’s state-law negligence claim to move forward. Creed & Gowdy attorneys Bryan Gowdy and Dimitri Peteves represented Mr. Montgomery in the Seventh Circuit, and they prepared and filed the petition for certiorari to the Supreme Court.
