Nick McNamara successfully defends bankruptcy court ruling in the Eleventh Circuit

On November 10, 2025, the United States Court of Appeals for the Eleventh Circuit affirmed a bankruptcy court decision finding that a bank account jointly owned by a husband and wife was held as a tenancy by the entirety, and therefore exempt from the claims of creditors. Mr. McNamara was appointed by the Eleventh Circuit as amicus counsel to defend the bankruptcy ruling, and orally argued the case on September 19, 2025 in Miami before Judges Frank Hull, Jill Pryor, and Robert Luck. In a published opinion by Judge Hull, the court found that the creditor failed to overcome Florida’s presumption that bank accounts jointly owned by married spouses are held as tenancies by the entirety.
