Creed & Gowdy Files Petition for Writ of Certiorari in the U.S. Supreme Court
Creed & Gowdy filed a petition for a writ of certiorari in the Supreme Court of the United States on behalf of Petitioners Thomas Navarro, James Giorgio, and Nina Shaffer. Petitioners are horse trainers and breeders who were sanctioned by SafeSport—a private corporation that, under federal law, polices abuse in amateur sports. Petitioners sued SafeSport, the United States Olympic & Paralympic Committee, and the United States Equestrian Federation, Inc. The government also intervened in the court of appeals. The petition argues that Congress unconstitutionally delegated legislative and other government powers to SafeSport in the Ted Stevens Olympic and Amateur Sports Act (ASA), 36 U.S.C. chapter 2205. Alternatively, the petition argues that SafeSport is a governmental actor subject to the Fifth Amendment’s Due Process Clause. You can read the petition here.
